Terms & Conditions

Please review our terms of service to understand your rights and responsibilities when engaging Gaudi Designs.

1. SMS & A2P Messaging Compliance

Gaudi Designs utilizes SMS for business communication, including quote updates, appointment reminders, and project status alerts. By providing your contact information, you explicitly consent to the following:

  • Opt-In: You agree to receive SMS messages from us. Message frequency varies.
  • Opt-Out: Text "STOP" to unsubscribe at any time. We will cease sending messages upon confirmation.
  • Help: Text "HELP" for assistance or contact us at (470) 229-0550.
  • Fees: Message and data rates may apply depending on your carrier plan.
  • Privacy: We strictly adhere to privacy standards. Your data is not sold or shared for third-party marketing.

2. Scope, Changes, & Scheduling

  • Scope & Changes: Work is limited to the defined scope. Unforeseen conditions, schedule impacts, or revisions require written Change Orders.
  • Schedule & Access: Client must provide site access, utilities, and suitable conditions. Delays caused by others may result in extensions and extra costs.
  • Acceleration: Weekend, holiday, night work, multiple shifts, or compressed schedules are subject to additional compensation.
  • Force Majeure: Delays caused by weather, labor/material shortages, transportation disruptions, utility outages, or governmental actions are excused.

3. Pricing, Payment, & Retention

  • Payment Terms: Pricing is valid for 30 days. Deposits and progress billing may apply. Late payments may incur finance charges, collection costs, attorney fees, and lien rights[cite: 8].
  • Material Escalation: Significant increases in epoxy, resin, cement, steel, freight, or fuel pricing may justify contract adjustments.
  • Completion & Retention: Payment is due upon substantial completion. Retention shall not exceed 5% unless otherwise agreed.

4. Compliance, Warranty, & Liability

  • Safety & Environmental: Work may be delayed by unsafe conditions, moisture, humidity, or failed testing.
  • Warranty: One-year workmanship warranty unless stated otherwise; excludes abuse, structural movement, moisture intrusion, or third-party damage.
  • Liability: Liability shall not exceed the value of the contracted work. Consequential damages, lost profits, and business interruption are excluded.

5. Confidentiality, Legal, & Disputes

  • Confidentiality: Enhanced confidentiality applies to high-profile, government, healthcare, and financial projects; photography and disclosure may be restricted.
  • Federal Work: Flow-down provisions, security, and certified payroll obligations apply where applicable.
  • Signatures: Digital approvals (DocuSign, Procore, email, etc.) are legally binding.
  • Dispute Resolution: Good-faith negotiation and mediation are required prior to litigation. Prevailing parties may recover attorney fees and court costs.
